1. Acceptance of Terms

By accessing or using the Alwaha HR Human Resources Consultancy ("Alwaha HR", "we", "us") website at alwaha-recruitment.ae ("Website") or engaging our recruitment services, you confirm that you have read, understood, and agree to be bound by these Terms of Service ("Terms") and our Privacy Policy.

If you do not agree to these Terms, please do not use our Website or services. These Terms apply to all visitors, employers, and job candidates who access or use the Website.

2. Our Services

Alwaha HR is a Dubai-based licensed recruitment agency that provides the following services:

• Sourcing and screening blue-collar workers from Uganda, Ghana, Nepal, and other approved countries
• Matching candidates to UAE employer requirements across sectors including construction, hospitality, facility management, manufacturing, transportation, and food & beverage
• Coordination of documentation, medical checks, and visa processing
• Pre-departure orientation and travel arrangement support
• Post-placement follow-up during the probation period

We reserve the right to modify, suspend, or discontinue any aspect of our services at any time without prior notice.

3. Agency's Role — We Are an Intermediary

Alwaha HR acts solely as a recruitment intermediary. We are not the employer of any worker we place, and we are not a party to any employment contract between an employer and a candidate.

The employment relationship — including wages, working conditions, benefits, accommodation, and compliance with UAE Labour Law — is exclusively between the employer and the worker. Alwaha HR does not control, direct, or supervise the employment terms once a placement is made.

4. Employer Obligations

By engaging Alwaha HR, employers agree to:

• Provide accurate, complete, and lawful job descriptions and requirements
• Comply with all applicable UAE labour laws, Ministry of Human Resources and Emiratisation (MOHRE) regulations, and immigration requirements
• Treat all candidates with dignity and in compliance with applicable anti-discrimination laws
• Pay agreed recruitment fees on time as specified in the signed service agreement
• Not use candidate CVs, profiles, or personal data for any purpose other than assessing their suitability for the advertised role

5. Candidate Obligations

Candidates who submit their information to Alwaha HR agree to:

• Provide truthful and accurate personal, professional, and educational information at all times
• Disclose any material information that may affect their eligibility to work in the UAE
• Not misrepresent qualifications, experience, certifications, or identity documents
• Understand that registration with Alwaha HR does not constitute an offer of employment or guarantee of placement

Providing false information is grounds for immediate withdrawal of any placement offer and may be reported to relevant authorities.

6. Fees & Payments

Recruitment fees are charged exclusively to employers, in accordance with UAE Labour Law and the ILO's principles on ethical recruitment. Alwaha HR does not charge fees to workers.

Specific fee structures, payment schedules, refund conditions, and replacement guarantees are set out in the individual service agreement signed between Alwaha HR and each employer. In the event of a conflict between these Terms and a signed service agreement, the service agreement prevails.

7. Confidentiality

All candidate CVs, employer job briefs, salary ranges, business processes, and any other information shared with Alwaha HR during the recruitment process is treated as confidential. We will not disclose such information to third parties without your explicit written consent, except where required by UAE law or a competent authority.

8. Intellectual Property

All content on this Website — including but not limited to the Alwaha HR name, logo, text, graphics, images, and page layouts — is the exclusive property of Alwaha HR Human Resources Consultancy and is protected under UAE and international intellectual property laws.

You may not reproduce, copy, distribute, or create derivative works from any part of this Website without our prior written consent.

9. Disclaimers

The Website and its content are provided on an "as is" and "as available" basis. Alwaha HR makes no warranties, express or implied, including but not limited to:

• That the Website will be uninterrupted, error-free, or free from viruses
• That a candidate will be successfully placed in employment
• That an employer will find a suitable candidate within a specific timeframe
• The accuracy, completeness, or suitability of any information on the Website

10. Limitation of Liability

To the fullest extent permitted by UAE law, Alwaha HR, its directors, employees, and agents shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with:

• Your use of or inability to use the Website or our services
• Any employment dispute between an employer and a placed worker
• Inaccurate information provided by either an employer or a candidate
• Delays caused by government authorities, visa processing, or factors outside our control

Our total aggregate liability, in any case, shall not exceed the fees paid by you to Alwaha HR in the three (3) months preceding the claim.

11. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the United Arab Emirates and the applicable regulations of the Emirate of Dubai. Any disputes arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of Dubai, UAE.

We encourage you to contact us first to resolve any concern informally before initiating formal proceedings.

12. Changes to These Terms

We may update these Terms from time to time to reflect changes in our services, applicable law, or business practices. When we do, we will update the "Last updated" date at the top of this page. We encourage you to review these Terms periodically.

Continued use of the Website or our services after changes take effect constitutes your acceptance of the revised Terms.
